Grammarly software Terms of Use
The University of Vienna provides its members with the Grammarly software, Grammarly Editor (https://app.grammarly.com/) and AI tools (hereinafter referred to as ‘Grammarly’) from Superhuman Platform Inc. (‘Superhuman’) as a software subscription. To use Grammarly, you need a Grammarly account with a personal license. This allows you to install Grammarly locally or use it online. These Terms of Use describe the scope of Grammarly's use.
The University of Vienna provides Grammarly under the following conditions:
- After completing the order for a Grammarly account in the Self Service Portal (order portal for employees), each user will be added to the Grammarly group in Azure AD in the University of Vienna's Microsoft Portal. Login to use Grammarly is similar to login for Microsoft 365, using your u:account UserID and associated password.
- The following data will be transmitted to Grammarly Inc. for the purpose of configuring the Grammarly account:
- e-mail address at the University of Vienna
- First name and surname
- The Grammarly account is a personal account, which means that the license is linked to the user and their e-mail address at the University of Vienna. Access data may not be passed on to other persons.
- Users expressly agree to these Terms of Use of the University of Vienna as well as any licence terms and privacy policy of Superhuman (Superhuman Customer Business Agreement at https://www.grammarly.com/terms/ customer-business-agreement, as well as Superhuman Privacy Policy at https://www.grammarly.com/privacy-policy and Additional European Information at https://www.grammarly.com/eea-privacy-notice).
- Current information on downloading, installation and use is available at https://support.grammarly.com/hc/en-us/articles/19812297751053-Get-started-with-Grammarly.
- When users use Grammarly, they are responsible for ensuring that their use complies with the law. Information on data storage can be found at https://www.grammarly.com/trust. Users can find information on artificial intelligence at https://www.grammarly.com/ai/responsible-ai.
- When using Grammarly, no sensitive data within the meaning of Art. 9 GDPR or data of category C – particularly sensitive internal business data – and D – special (sensitive) categories of data within the meaning of data protection law – should be processed in accordance with the framework operating agreement RBV-Daten of the University of Vienna.
- The General Data Protection Declaration of the University of Vienna, the Data Protection Declaration of the University of Vienna for Cloud Services and Other IT Applications, and the Framework Operating Agreement RBV Data provide further notes on the suitability of data that can be processed with Grammarly.
- If you use Grammarly's AI tools, you agree to comply with the Terms of Use in connection with artificial intelligence (AI) at the University of Vienna.
- The University of Vienna accepts no liability for the content and data made available in the course of using Grammarly.
- Furthermore, the University of Vienna does not guarantee the availability, reliability, functionality and usability of Grammarly for the purposes intended by the user.
- The University of Vienna also accepts no liability for any defects in Grammarly.
- The licence terms stipulate that the Grammarly software may only be used for the following purposes:
- for teaching
- for science
- for research
- for the development of teaching software
- for internal university administrative purposes
- Use for other purposes, such as private usage or for other institutions, is prohibited.
- Use for commercial purposes is prohibited.
- The use of the Grammarly software is limited to the duration of the license purchased by the University of Vienna.
- The use of the Grammarly software is limited to the duration of active employment at the University of Vienna for employees.
- Users who wish to delete their Grammarly account can do so via the Self Service Portal (order portal for employees).
- After returning the Grammarly account via the Self Service Portal (order portal for employees), the license will be deactivated and the Grammarly account will be cleared after 30 days (general information regarding the clearing of a Grammarly account can be found at https://support.grammarly.com/hc/en-us/ articles/115000090052-Delete-your-Grammarly-account).
- There is no provision for restoring data after the Grammarly account has been deleted. Therefore, please save any data you still need or find an alternative option (https://www.grammarly.com/plans) in good time before returning your Grammarly account so that you can continue to use Grammarly and access your data.
- Users are not permitted to use the Grammarly software in any way that is prohibited by laws, regulations or official orders or decrees in any relevant jurisdiction. Furthermore, the permissions of other persons may not be infringed upon through the use of Grammarly.
- Any disputes arising from these Terms of Use or from the use of Grammarly shall be settled before the competent courts in Vienna.
