Adobe software Terms of Use

The University of Vienna provides its administrative, teaching and research employees with software products from Adobe Systems Software Ireland Limited (hereinafter referred to as ‘Adobe software’) under the personalised license (hereinafter referred to as ‘named user license’) licensing procedure. These Terms of Use describe the scope to which Adobe software can be used within the framework of Adobe Creative Cloud.

The University of Vienna provides the named user licence for Adobe software within the framework of Adobe Creative Cloud under the following conditions:

1. Once the Adobe account has been ordered in the self-service portal (order portal for employees), each user is entered into the Adobe group in Azure AD in the Microsoft portal of the University of Vienna. Login to use Adobe is similar to login for Microsoft 365 with u:account UserID and associated password.
2. The following data is transmitted to Adobe for configuring the Adobe account:
   1. e-mail in the form u:account UserID@univie.ac.at
   2. First name and surname
3. Each user receives a personal Adobe account, which means that the license is linked to the user and their e-mail at the University of Vienna. Access data may not be passed on to other persons.
4. Users can install Adobe software on different devices, but can only be logged in on two devices at the same time. For more information, see Install, active, or use Adobe apps on an additional device.
5. For performance reasons (download, installation), Adobe Acrobat software is provided separately. However, the license in the background also includes the complete Adobe Creative Cloud.

7. Adobe Document Cloud is part of Adobe Creative Cloud and is included in the named user license.
8. When users use Adobe Document Cloud, they are responsible for ensuring that their use is legally compliant.
9. When using Adobe Document Cloud, no sensitive data within the meaning of Art. 9 GDPR or data of category C (particularly sensitive internal business data) and D (special – sensitive – categories of data within the meaning of data protection law) within the meaning of the Company-Level Agreement RBV-Daten (Betriebsvereinbarung, in German) of the University of Vienna may be processed.
10. The data protection policy of the University of Vienna and the Company-Level Agreement RBV-Daten (Betriebsvereinbarung, in German) provide further notes on the suitability of data for storage in Adobe Document Cloud.
11. The University of Vienna accepts no liability for the content and data made available in the course of using Adobe Document Cloud.
12. Furthermore, the University of Vienna does not guarantee the availability, availability, functionality and usability of Adobe software within the framework of Adobe Creative Cloud for the purposes intended by the employee.
13. The University of Vienna also accepts no liability for any defects in Adobe software within the framework of Adobe Creative Cloud.
14. Users expressly undertake to comply with these terms of use of the University of Vienna and any licence conditions of Adobe software.
15. The current licence terms for Adobe software can be found on the Adobe website Product Licenses and Terms of Use and must be complied with.
16. The licence terms stipulate that Adobe software may only be used for the following purposes:
    1. for teaching
    2. for science
    3. for research
    4. for the development of educational software
    5. for internal administrative purposes
17. Use for other purposes, such as private usage or for other institutions, is prohibited.
18. Use for commercial purposes is prohibited.
19. The use of Adobe software as part of Adobe Creative Cloud is limited to the duration of the license purchased by the University of Vienna.
20. The use of Adobe software is restricted to employees for the duration of their active employment at the University of Vienna.
21. Once the Adobe account has been returned via the self-service portal (ordering portal for employees), it will be deactivated on the Adobe portal and cleared after 30 days.
22. It is not possible to recover data once the Adobe account has been deleted. Please save any data you still need, or ensure you arrange an alternative solution in good time before returning your Adobe account so that you can continue to use the Adobe software.
23. Users do not have permission to use Adobe software as part of Adobe Creative Cloud in any manner prohibited by laws, regulations or official orders or decrees in any relevant jurisdiction. Furthermore, the permissions of other persons must not be infringed upon through the use of Adobe software as part of Adobe Creative Cloud.
24. Any disputes arising from these Terms of Use or from the use of Adobe software as part of Adobe Creative Cloud shall be settled before the competent courts in Vienna.
