u:stream declaration of consent

By using the u:stream services, I agree that the University of Vienna reproduces, distributes, sends or provides the public with audio and/or video recordings on a time-delayed, repeated and long-term basis

  • for the purposes of teaching and research as well as
  • communication inside and outside of the University.  

 If I use the function, this declaration of consent also applies to the contents of livestreams.

The initial step for the publication of a u:stream series, livestream and/or a video needs to be taken by me or other authorised persons. Without this initial step, the recordings will not be published.

If personal data of third parties is processed through a recording, I have to ensure that processing takes place in accordance with statutory requirements, in particular the applicable data protection regulations. The University of Vienna is not liable for any unlawful recordings and their storage.

Declaration of consent in accordance with data protection regulations

I hereby consent to the processing of my personal data by the University of Vienna, Universitätsring 1, 1010 Vienna, Austria for the purposes of teaching, research and communication inside and outside of the University.

My personal data may be processed:

  • as part of recordings and livestreams from lecture halls equipped with u:stream;
  • when uploading audio and video files to u:stream;
  • when making video recordings via a web-based tool.

All series and videos as well as photos and audio recordings that they contain can also be edited by authorised users.

u:stream cameras in certain rooms can also be used as a source for video conferencing tools (Zoom, Big Blue Button).

My personal data will not be published without my consent.

This consent is given voluntarily. I will not suffer any negative consequences if I do not give my consent. I have the right to withdraw my consent at any time with future effect. I can withdraw my consent by contacting: ustream.zid@univie.ac.at

The University of Vienna will erase or anonymise all relevant data stored as soon as they receive my withdrawal of consent. Furthermore, authorised persons can delete recordings themselves via the u:stream administration.

I hereby declare that I have been informed and am fully aware of the information obligations of the University of Vienna (see below).

Information obligations of the University of Vienna

The University of Vienna is the controller, i.e. the entity responsible for this processing activity, in accordance with the General Data Protection Regulation (GDPR). According to the GDPR, the controller is obliged to provide information to data subjects. Therefore, please take note of the following information:

B. Objective and purpose of the processing activity

For the purpose of this processing activity, u:stream of the University of Vienna processes personal data. This personal data can be processed for on-demand streaming (i.e. by publishing a video in Moodle or activating a hyperlink)

  • as part of recordings and livestreams from lecture halls equipped with u:stream;
  • when uploading audio and video files to u:stream;
  • when making video recordings via a web-based tool.

All series and videos as well as photos and audio recordings that they contain can also be edited by authorised users.

u:stream cameras in certain rooms can also be used as a source for video conferencing tools (Zoom, Big Blue Button).

In addition, the following applies to recordings and livestreams from lecture halls equipped with u:stream: In the control web interface, you can select whether you want to record and/or livestream. This selection can be changed at any time. In addition, the processed data (recording of the lecture hall, projector image or an audio recording) can be changed at any time.

Other persons besides the person who registered the series can be authorised to edit a u:stream series and the videos it contains.

  • For u:stream series of courses, all persons entered in i3v as persons with editing permissions will be authorised automatically.
  • When linking a u:stream series to a Moodle course, the persons authorised to edit the Moodle course will also be granted relevant permissions.
  • For all u:stream series, the persons who register the series and/or authorised persons may grant permissions to additional persons.

Based on the legal framework of the Austrian web accessibility act (Web-Zugänglichkeits-Gesetz, WZG), the Vienna University Computer Center is adding auto-generated subtitles to on-demand streams (audio and video). English subtitles can be automatically generated for content that is not in English. The Vienna University Computer Center does not assume warranty for any deficiencies of the automatically generated subtitles. If necessary, authorised persons can opt out of the automatic subtitles or edit them later on. The Vienna University Computer Center reserves the right to generate transcripts from the subtitles which the authorised persons can optionally provide to the viewers.
 

C. Legal foundations of the processing activity:

The legal foundation of the processing activity is the consent that you have given in accordance with Article 6, para. 1, lit. a of the GDPR. The University of Vienna may not be able to comply with its obligations to you if you do not provide your personal data. This applies if the provision of personal data is a statutory or contractual requirement, or a requirement necessary to enter into a contract.
 

D. Transfer to third parties

Your personal data will not be transferred to third parties outside the University. No personal data will be transferred to third parties outside the University without your separate consent. Your personal data will not be transferred to recipients in a third country (EU or EEA country) or an international organisation.
 

E. Storage period

The data specified above will be stored for 5 years, provided that the purpose of the data processing activity still applies and if no other statutory storage period applies.
 

F. Information about the rights of data subjects

As a data subject of this processing activity, you have the following rights towards the University of Vienna:

  • right to information, Article 15 of the GDPR
  • right to rectification, Article 16 of the GDPR
  • right to erasure, Article 17 of the GDPR
  • right to restriction of processing, Article 18 of the GDPR
  • right to data portability, Article 20 of the GDPR
  • right to object, Article 21 of the GDPR

You can also lodge a complaint with the Data Protection Authority at any time in accordance with Article 77 of the GDPR:
